Clear Creation – Web Hosting Terms and Conditions
Effective Date: 23/06/2025
These Hosting Terms and Conditions (“Terms”) apply to all hosting services (“Services”) provided by Clear Creation (“we”, “us”, or “our”) to you (“Client”, “you”, or “your”).
By using our hosting services, you agree to these Terms.
1. Hosting Services Provided
We provide shared or managed hosting services for websites, which includes:
- Server space
- SSL certificate setup
- Weekly backups
- Critical technical support (within business hours)*
Critical technical support covers emergencies such as website outage, or any other major error directly related to our hosting service. Any other support may be billable.
Specific details of your hosting package will be outlined in your individual service agreement or invoice.
2. Client Responsibilities
You agree:
- Not to upload or host illegal, malicious, or offensive content.
- Not to engage in activities that compromise server security or performance (e.g. spamming, hacking, DDoS).
- To keep your login credentials safe and inform us immediately if compromised.
3. Uptime & Backups
We aim for 99.9% uptime but do not guarantee uninterrupted service. Routine maintenance or third-party outages may affect availability.
Backups are made weekly, but we recommend clients maintain their own back-up copies. We cannot guarantee 100% viability of back-up copies. We are not liable for data loss unless due to our negligence.
4. Payments & Renewals
- Hosting fees are payable yearly, in advance.
- Late payments may result in suspension of your hosting account.
- We’ll notify you ahead of renewal dates. Failure to pay may lead to account termination after 14 days of non-payment.
5. Cancellation & Termination
You may cancel hosting at any time with 30 days notice in writing. We do not offer refunds for partial months.
We may suspend or terminate services without notice if:
- You violate these terms.
- You fail to pay fees due.
- Your site poses a risk to our server or other clients.
6. Liability Limitation
We are not liable for:
- Loss of data or revenue due to downtime, unless caused by our negligence.
- Third-party failures (e.g. data centres, domain registrars).
- Any indirect or consequential loss.
Our total liability will not exceed the total amount you have paid for hosting in the previous 12 months.
7. Support
Hosting support is available via email during business hours (Monday–Friday, 9am–5pm UK time).
8. Amendments
We may update these Terms from time to time. Continued use of our hosting services after changes are made constitutes your acceptance of the new terms.
9. Security & Website Compromise
While we take standard measures to secure our servers, you are responsible for the security of your website, including:
- Keeping CMS platforms (e.g. WordPress), themes, and plugins up to date
- Using strong passwords and secure login methods
- Avoiding the use of insecure or outdated third-party tools
We are not liable for any website compromise, hacking, malware infection, or unauthorised access that occurs due to client-side vulnerabilities, including but not limited to outdated software, weak passwords, or poor security practices.
In the event of a compromise:
- We reserve the right to suspend the affected site to protect the server and other clients.
- Any clean-up, restoration, or malware removal may incur additional charges unless otherwise agreed in writing.
